The sale of our goods and services is subject to the following conditions and these form the contract between you and us
(Hydrapro). Please note these conditions do not affect your statutory rights. There is no binding agreement between you
and us until it is confirmed in writing in our standard format by us. We reserve the right to accept or reject any order
for any reason whatsoever at any time. Whilst every effort is made to be accurate we will not be responsible for any
typographical error in our advertising material including our website.
Payment
Upon placing your order we may pre-authorize your card which means the amount is reserved and removed from your
available spending limit but the funds are not deducted (and thus will not show on your statement) until your order
has been reviewed. If items need to be credited back to your account then the full amount will be debited and then a
credit processed afterwards. This may take a few days to come through. All payments are taken in GBP, sums displayed
on the site in other currencies are purely for indication purposes only. You may use Google Checkout or RBS worldpay
to purchase goods online, or you may mail to us a personal cheque drawn on UK funds, we also accept bank transfers. We
aim to protect legitimate credit card owners from fraud and therefore will report to the necessary authorities any
person attempting to use a card which they are not authorized to use.
Orders
All products are subject to availability. Orders submitted online are subject to acceptance by us and may be declined
either all or in part at our absolute discretion and in the event that any such order is declined, the payment submitted
with the order will be refunded as soon as possible. The quantity, quality and description of any specifications for the
products shall be those set out in the site but you should be aware that the images appearing on the website are not
always accurate. All pictures on our website are for graphic representation only and products shipped may differ slightly
from images. We reserve the right to correct errors and omissions in any price or other information without any liability.
Property
Hydrapro asserts all of its intellectual property rights in all of its promotional materials and trademarks. Property
in the product shall pass to you provided your payment has cleared and/or received.
Warranties & Liability
We shall not accept any liability for the content of any other websites linking into this site to the extent permitted
by law. All products supplied conform to all relevant British and European standards.
Returning unwanted, wrong size or faulty goods
If any product that is purchased is not the correct size for you then we will exchange it for the correct size provided
that the product has not been used in any way and is returned to us in its original packing. If any product that is
purchased is faulty we will exchange it for an identical replacement free of charge provided that the product is returned
to us in its original packaging and we are notified of the fault. The replacement is at the discretion of the
management/technician. Please note that fault during use, such as flooding, may require goods to be returned to the
manufacturer for warranty confirmation. Please contact Hydrapro before returning any unwanted items. A full refund
(minus the cost of posting the item to you) will be issued for any unused returned goods within 7 days as per the distance
selling regulations. A restocking fee of 10% will be charged for goods that were a special order.
Export
We only offer refunds on faulty goods to countries inside the European Union. If goods are to be shipped or used overseas
then it is your responsibility to ensure that the product is able to be shipped to and used in your country, and that you
have the correct qualifications to purchase the items. Incorrectly sized items (suits and BCDs), excluding cylinders,
dispatched inside or outside the United Kingdom and inside the European Union can be swapped. However, the customer is
responsible for the cost of shipping the items back to us as well as the return carriage costs back to the customer. If
any product that is purchased is faulty we will exchange it for an identical replacement free of charge or a full refund.
We do not accept any responsibility for shipment delays due to customs issues and/or for any excise duties levied on a
consignment due to it being a circumstance beyond our reasonable control.
Cancellations
The Distance Contracts Regulations 2000 (or any amending provisions) state, amongst other things, that you have the
right to cancel the contract for any reason within seven days of delivery of goods. If you wish to cancel, please notify
us in writing to our address. You will then be refunded within thirty days and may return the goods to us, although this
will be at your cost and if we have to collect them we may deduct the collection costs from the refund paid to you minus
any expenses incurred. During the period that you retain the goods until they are returned to us, you must take reasonable
care of them to prevent damage. This guarantee does not affect your statutory rights.
Disclaimer
Professional training and certification from a reputable diving agency in the technique of SCUBA diving must be
successfully carried out before use of our products featured on the website. Use of SCUBA equipment by uncertified
or untrained persons is dangerous and could result in SERIOUS INJURY OR DEATH.
Any equipment purchased and received from Hydrapro is done so on the understanding that the customer/purchaser is
fully trained in the use of the SCUBA equipment and holds the relevant qualifications.
Goods on the site may only be sold to persons aged 18 or over. In placing an order for any such goods you represent and
warrant that you are at least 18 years old. We reserve the right to refuse any order where satisfactory proof of age has
not been provided.
